PRIVACY POLICY
In this privacy policy, I, ML Services GmbH, CH-8008 Zurich, Managing Director: Manuela Leonhard, e-mail: info@manuelaleonhard.ch, explain how I process personal data. The privacy policy clarifies the nature, scope and purpose of the processing of this data within my online offer and the associated websites, functions and content as well as external online presences such as my social media channels. I would like to point out that data transmission over the Internet (e.g. when communicating by email) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.
If you provide me with personal data of other persons (e.g. family members, data of work colleagues), please ensure that these persons are aware of this privacy policy and only share their personal data with me if you are permitted to do so and if this personal data is correct.
1. controller/data protection officer
Manuela Leonhard is responsible for the data processing described here, unless otherwise stated in individual cases. If you have any data protection concerns, you can send them to me at the following contact address: CH-8008 Effretikon and info@manuelaleonhard.ch.
2. collection & processing of personal data
I primarily process the personal data that I receive from my customers and other business partners as part of my business relationship with them and other persons involved or that I collect from their users when operating my websites, apps and other applications. This includes the following data
- Inventory data (e.g., names, addresses).
- Contact data (e.g., e-mail, telephone numbers).
- Content data (e.g., text entries, photographs, videos).
- Usage data (e.g., websites visited, interest in content, access times).
- Meta/communication data (e.g., device information, IP addresses).
To the extent permitted, I also extract certain data from publicly accessible sources (e.g. press, internet). In addition to the data that you provide to me directly, the categories include personal data that I receive about you from third parties, information about you in correspondence and meetings with third parties, credit information (insofar as we conduct business with you personally), information about you that people from your environment (superiors, employees, etc.) provide to us so that we can conclude contracts with you. This includes, for example, references, your address for deliveries, sales and other contractual partners of mine for the utilization or provision of services by you (e.g. payments made, purchases made, etc.). e.g. payments made, purchases made), information about you from the media and the internet (if this is appropriate in the specific case, e.g. as part of an application, press review, marketing/sales, etc.), your addresses and, if applicable, interests and other socio-demographic data (for marketing), data in connection with the use of the website (e.g. IP address, MAC address of the smartphone or computer, information about your device and settings, cookies, date and time of the visit, pages and content accessed, functions used, referring website, location data).
3. Purposes of data processing & legal basis
I use the personal data collected primarily to conclude and process my orders with my customers and business partners, in particular in the context of photographic/filming activities and personnel/social media management, as well as to comply with my legal obligations in Switzerland and abroad. If you work for such a client or business partner, your personal data may of course also be affected in this function. The purpose of the processing includes the following aspects
- Provision of the online offer, its functions and content.
- Answering contact inquiries and communicating with users.
- Security measures.
- Reach measurement/marketing
If you have given me your consent to process your personal data for specific purposes (for example, when you register to receive newsletters or carry out a background check), I will process your personal data within the scope of and based on this consent, unless I have another legal basis and require one. Consent that has been given can be withdrawn at any time, but this has no effect on data processing that has already taken place.
4. cookies
I typically use "cookies" and similar technologies on my websites to identify your browser or device. A cookie is a small file that is sent to your computer or automatically stored on your computer or mobile device by the web browser you use when you visit my website. This enables us to recognize you when you return to this website, even if we do not know who you are. In addition to cookies that are only used during a session and are deleted after your visit to the website ("session cookies"), cookies can also be used to store user settings and other information for a certain period of time (e.g. two years) ("permanent cookies"). However, you can set your browser so that it rejects cookies, only stores them for one session or otherwise deletes them prematurely. Most browsers are preset to accept cookies. We use permanent cookies so that you can save user settings (e.g. language) so that I can better understand how you use our offers and content. If you block cookies, certain functions (e.g. language selection) may no longer work.
In some of my newsletters and other marketing emails, I also incorporate visible and invisible image elements, where permitted, which I can retrieve from my servers to determine whether and when you have opened the email so that I can measure and better understand how you use my offers and tailor them to you.
By using my websites and agreeing to receive newsletters and other marketing emails, you consent to the use of these techniques. If you do not want this, you must set your browser or e-mail program accordingly.
5. Tracking and other technologies
Google Analytics
I sometimes use Google Analytics or similar services on my website. This is a third-party service that may be located in any country in the world (in the case of Google Analytics, it is Google LLC in the USA, www.google.com), with which I can measure and evaluate the use of the website (non-personal). Permanent cookies set by the service provider are also used for this purpose. The service provider does not receive any personal data from us (and does not store any IP addresses), but can track your use of the website, combine this information with data from other websites that you have visited and which are also tracked by the service provider, and use these findings for its own purposes (e.g. control of advertising). If you have registered with the service provider yourself, the service provider also knows you. The processing of your personal data by the service provider is then the responsibility of the service provider in accordance with its data protection provisions. The service provider only informs me how our respective website is used (no information about you personally).
You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the browser plug-in available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de
You can find more information on how Google Analytics handles user data in Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=de
This website uses the "demographic features" function of Google Analytics. This allows reports to be created that contain statements about the age, gender and interests of site visitors. This data comes from interest-based advertising from Google and visitor data from third-party providers. This data cannot be assigned to a specific person. You can deactivate this function at any time via the ad settings in your Google account or generally prohibit the collection of your data by Google Analytics as described in the section "Objection to data collection".
Hosting provider & server log files
The provider of the site automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are
- IP address- Browser type and browser version
- Operating system used
- referrer URL
- Host name of the accessing computer
- Time of the server request
This data cannot be directly assigned to specific persons. This data is not merged with other data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of unlawful use. This data and all data on this website is stored by our hosting provider Hostpoint AG, Neue Jonastrasse 60, CH-8640 Rapperswil, whose privacy policy can be found here.
SSL encryption
This site uses SSL encryption for security reasons and to protect the transmission of confidential content, such as the requests you send to me as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. If SSL encryption is activated, the data you send to me cannot be read by third parties.
Social plugins
I also use so-called plug-ins from social networks such as Facebook (Meta), LinkedIn, Instagram or YouTube (Google) on my websites. This is visible to you in each case (typically via corresponding symbols). We have configured these elements so that they are deactivated by default. If you activate them (by clicking on them), the operators of the respective social networks can register that you are on my website and where and can use this information for their purposes. The processing of your personal data is then the responsibility of this operator in accordance with its data protection regulations. I do not receive any information about you from them.
Newsletter dispatch
If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. We use this data exclusively for sending the requested information. You can revoke your consent to the storage of the data, the e-mail address and its use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter. Subscriptions to the newsletter are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation as well as the IP address. Changes to your data stored with MailChimp are also logged.
You can unsubscribe from our newsletter at any time, i.e. revoke your consent. At the same time, your consent to the sending of the newsletter via MailChimp and the statistical analyses will expire. Unfortunately, it is not possible to cancel the sending of the newsletter via MailChimp or the statistical analysis separately. You will find a link to unsubscribe from the newsletter at the end of each newsletter.
Mailchimp
The newsletter is sent via "MailChimp", a newsletter distribution platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. The email addresses of our newsletter recipients, as well as their other data described in this notice, are stored on MailChimp's servers in the USA. MailChimp uses this information to send and analyze the newsletter on our behalf. Furthermore, MailChimp may, according to its own information, use this data to optimize or improve its own services, e.g. for the technical optimization of the dispatch and presentation of the newsletter or for economic purposes in order to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them itself or to pass it on to third parties. We trust in the reliability and IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement "Privacy Shield" and thus undertakes to comply with EU data protection regulations. We have also concluded a "Data Processing Agreement" with MailChimp. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with its data protection provisions and, in particular, not to pass it on to third parties. You can view MailChimp's privacy policy here.
6 Data disclosure and transfer abroad
As part of our business activities and for the purposes set out in Section 3, we also disclose data to third parties to the extent permitted and deemed appropriate, either because they process it for us or because they wish to use it for their own purposes. This applies in particular to the following parties:
- Service providers of ours including contract processors (such as IT providers);
- Dealers, suppliers, subcontractors and other business partners;- customers;
- domestic and foreign authorities, official bodies or courts;
- the media;
- the public, including visitors to websites and social media;
- competitors, industry organizations, associations, organizations and other bodies;all joint recipients.
These recipients are partly domestic, but can be anywhere in the world. In particular, you must expect your data to be transferred to all countries in which I am active through the aforementioned business activities as well as to other countries in Europe and the USA where the service providers we use are located (such as Mailchimp). If we transfer data to a country without adequate legal data protection, we ensure an adequate level of protection as provided for by law by using appropriate contracts or so-called Binding Corporate Rules or rely on the legal exceptions of consent, contract execution, the establishment, exercise or enforcement of legal claims, overriding public interests, published personal data or because it is necessary to protect the integrity of the data subjects. You can obtain a copy of the aforementioned contractual guarantees at any time from the contact person named in section 1. However, we reserve the right to redact copies for reasons of data protection or confidentiality or to provide only excerpts.
7 Duration and storage of personal data
We process and store your personal data for as long as is necessary for the fulfillment of our contractual and legal obligations or otherwise for the purposes pursued with the processing, i.e., for example, for the duration of the entire business relationship (from the initiation, execution to the termination of a contract) as well as beyond that in accordance with the statutory retention and documentation obligations. It is possible that personal data may be stored for the period in which claims can be asserted against our company and insofar as we are otherwise legally obliged to do so or legitimate business interests require this (e.g. for evidence and documentation purposes). As soon as your personal data is no longer required for the above-mentioned purposes, it will be deleted or anonymized as far as possible. For operational data (e.g. system protocols, logs), shorter retention periods of twelve months or less generally apply.
8 Data security
We take appropriate technical and organizational security precautions to protect your personal data from unauthorized access and misuse, such as issuing instructions, IT and network security solutions and encryption of data carriers (https).
9. obligation to provide personal dataAs part of our business relationship, you must provide the personal data that is necessary for the establishment and implementation of a business relationship and the fulfillment of the associated contractual obligations (as a rule, you do not have a legal obligation to provide us with data). Without this data, we will generally not be able to conclude or execute a contract with you (or the entity or person you represent). The website can also not be used if certain information to secure data traffic (such as IP address) is not disclosed.
10 Rights of the data subject
If the relevant legal requirements are met, you have the following rights:
- the right to request information about your personal data stored by us;
- the right to have incorrect or incomplete personal data corrected;the right to request the deletion or anonymization of your personal data;
- the right to request the restriction of the processing of your personal data;
- the right to receive certain personal data in a structured, commonly used and machine-readable format
- the right to withdraw consent with effect for the future, insofar as processing is based on consent.
Please note that we reserve the right to assert the restrictions provided for by law, for example if we are obliged to store or process certain data, have an overriding interest in doing so (insofar as we are entitled to invoke this) or require it for the assertion of claims.
The exercise of such rights generally requires that you clearly prove your identity (e.g. by providing a copy of your ID). To assert your rights, you can contact us at the address given above.
Every data subject also has the right to enforce their claims in court or to lodge a complaint with the competent data protection authority. The competent data protection authority in Switzerland is the Federal Data Protection and Information Commissioner (http://www.edoeb.admin.ch).
